Special Session B of the Florida Legislature

Ch. 2005-353 (S.B. 18-B)  Implements s. 24, Art. X of the State Constitution to increase the state minimum wage to $6.15 per hour; provides for annual adjustment; mandates publication and notification of wage rate information; penalizes violations. Effective December 12, 2005.

Ch. 2005-354 (S.B. 12-B)  Provides for the relief of Wilton Dedge. Effective December 14, 2005.

Ch. 2005-355 (H.B. 15-B)  Authorizes the governing body of a county that has been declared a major disaster area to adopt options extending the eligibility period for an early-payment discount of ad valorem taxes; prescribes options and notice requirements. Effective December 14, 2005.

Ch. 2005-356 (H.B. 41-B)  Increases the number of circuit court judges in the Twentieth Judicial Circuit and increases the number of county court judges in Collier County; provides for appointment and funding. Effective December 14, 2005, except as otherwise provided.

Ch. 2005-357 (H.B. 31-B)  Creates the NASCAR license plate under certain circumstances; provides for annual use fee collection and distribution. Effective 30 days after Daytona Beach is designated by NASCAR as the site of the NASCAR Hall of Fame; contingency did not occur.

Ch. 2005-358 (H.B. 3-B)  Revises provisions relating to Medicaid; mandates creation of a Medicaid Low-Income Pool Council and provides for membership, powers, and duties; expands the Medicaid managed care pilot program; requires specified quarterly and annual reports. Effective December 16, 2005.

Ch. 2005-359 (S.B. 6-B)  Revises provisions relating to various lobbying activities; provides for filing of certain reports and information electronically; prohibits persons convicted of a felony from registering as lobbyists until specified conditions are satisfied. Effective January 1, 2006, except as otherwise provided.

Ch. 2005-360 (S.B. 8-B)  Prescribes requirements and conditions for making in-kind contributions to political parties and the parties’ acceptance of such contributions; mandates filing of specified reports. Effective February 1, 2006.

Ch. 2005-361 (S.B. 40-B)  Provides an exemption from public records requirements for certain lobbying firm audit or investigation records.  Provides an exemption from public meetings requirements for any meetings held pursuant to such an investigation or at which such audit is discussed.  Provides for future review and repeal.  Effective January 1, 2006.

Ch. 2005-362 (H.B. 1-B)  Creates various provisions relating to slot machine gaming; defines specified terms; delineates powers and duties of certain governmental entities; provides for licensure, oversight, fees, and taxation; conforms specified provisions. Effective January 4, 2006.

Regular Session of the Florida Legislature

Ch. 2006-1 (H.B. 7067)  Amends, repeals, or reenacts various provisions in the Florida Statutes to replace incorrect cross-references, delete obsolete or expired provisions, correct grammatical and typographical errors, remove inconsistencies and redundancies, and otherwise improve the clarity of the statutes. Effective July 4, 2006.

Ch. 2006-2 (H.B. 7069)  Repeals numerous provisions of the Florida Statutes which were repealed other than by a “current session” of the Legislature, for the purpose of omitting such provisions from publication in the Florida Statutes 2006. Effective July 4, 2006.

Ch. 2006-3 (H.B. 7071)  Designates portions of the Florida Statutes 2006 which constitute the official statute law of the state. Designates general laws which are, and which are not, repealed by adoption of the Florida Statutes 2006. Effective July 4, 2006.

Ch. 2006-4 (H.B. 167)  Revises provisions relating to household moving services; requires specified insurance coverage; provides penalties for violation and provides for alternative methods of coverage. Prescribes circumstance under which a county or municipality may issue or renew an occupational license to a mover or moving broker. Effective July 1, 2006.

Ch. 2006-5 (H.B. 201)  Revises provisions relating to possessory lien notice, attachment, and satisfaction requirements for the nonjudicial sale of vessels. Effective July 1, 2006.

Ch. 2006-6 (H.B. 145)  Deletes provisions relating to percentage of fault in the apportionment of economic damages in civil actions. Effective April 26, 2006.

Ch. 2006-7 (H.B. 47)  Provides an exemption from sales and use tax for sales of specified goods from May 21, 2006 through June 1, 2006; excludes certain goods; provides for rulemaking and administration. Effective April 27, 2006.

Ch. 2006-8 (S.B. 542)  Clarifies that the administrative law judge has exclusive jurisdiction to make factual determinations regarding satisfaction of certain notice requirements under the Florida Birth-Related Neurological Injury Compensation Plan; authorizes the State Board of Administration to invest and reinvest plan funds. Effective May 2, 2006.

Ch. 2006-9 (H.B. 599)  Creates the Florida Faith-based and Community-based Advisory Council to facilitate the effective delivery of services to the community; provides for membership, duties, and term of office. Effective July 1, 2006.

Ch. 2006-10 (H.B. 219)  Establishes a cap on the amount a labor pool may charge a day laborer for travel; permits such labor pools to provide payment via cash-dispensing machines under specified conditions; provides certain licensure applicability. Effective July 1, 2006.

Ch. 2006-11 (H.B. 1567)  Creates and revises provisions relating to eminent domain; prescribes conditions for conveyance of property acquired through eminent domain to natural persons or private entities; prohibits the use of eminent domain to eliminate nuisance, slum, or blight conditions. Effective May 11, 2006.

Ch. 2006-12 (C.S. for C.S. for S.B. 1980)  Creates and revises provisions relating to property and casualty insurance; repeals the requirement for development of a low-interest loan program for retrofitting homes to reduce hurricane damage or loss. Effective May 16, 2006, except as otherwise provided.

Ch. 2006-13 (H.B. 1039)  Revises provisions relating to the Miami-Dade County Lake Belt Plan and the Miami-Dade County Lake Belt Mitigation Plan; designates a specified impoundment project as the “Fran Reich Preserve.” Effective January 1, 2007.

Ch. 2006-14 (H.B. 7119)  Requires the Florida High School Athletic Association to hold specified laws in abeyance; creates a Student Athlete Recruiting Task Force to review issues regarding recruitment of secondary school student athletes; provides for task force membership and duties. Effective May 23, 2006.

Ch. 2006-15 (C.S. for S.B. 394)  Permits the Agency for Persons with Disabilities to amend certain budgetary requests; requires specified reports; includes the agency within the entities administering the consumer-directed care program. Effective May 25, 2006.

Ch. 2006-16 (C.S. for S.B. 818)  Modifies provisions relating to transfer of specified funds from the Fuel Tax Collection Trust Fund to the Florida Coastal Protection Trust Fund and the Inland Protection Trust Fund. Effective July 1, 2006.

Ch. 2006-17 (C.S. for S.B. 840)  Authorizes the Agency for Workforce Innovation to contract for the administration of the Teacher Education and Compensation Helps (TEACH) scholarship program; requires the agency to recommend a funds allocation formula based on equity and performance. Effective July 1, 2006.

Ch. 2006-18 (C.S. for S.B. 844)  Prescribes the classification, salary, and benefits plans of specified state employees; revises provisions relating to health savings accounts, the prescription drug program, wages and salaries, and travel expenses. Effective July 1, 2006.

Ch. 2006-28 (H.B. 5007)  Revises provisions relating to health care; creates a pharmaceutical expense assistance program for certain cancer patients; provides for program eligibility, administration, and funding; repeals an enrollment ceiling for a specified portion of the Florida Kidcare program. Ch. 2006-29 (H.B. 5009)  Revises provisions relating to reimbursement and funding rates for substance abuse and mental health services providers. Effective July 1, 2006.

Ch. 2006-30 (H.B. 5011)  Revises provisions relating to foster care and related services to provide for a community-based care risk pool initiative, certain interest-free loans, and a pilot project transferring certain government oversight responsibilities to independent entities. Effective July 1, 2006, except as otherwise provided.

Ch. 2006-31 (H.B. 5013)  Eliminates certain authority of the Department of Children and Family Services and the Department of Health to use fee collections in excess of fee-supported appropriations for specified purposes. Effective July 1, 2006.

Ch. 2006-32 (H.B. 5017)  Eliminates the Florida Corrections Commission; conforms specified provisions to provide that an annual report on elderly offenders and certain contract considerations be done by other specified governmental entities; revises provisions relating to consensus prison per diem rates developed for legislative use. Effective July 1, 2006.

Ch. 2006-33 (H.B. 5021)  Permits only one trial continuance in a case to commit a sexually violent predator; provides an exception; requires maintenance of a registry of mental health and other experts to provide examinations and expert testimony is such cases. Effective July 1, 2006.

Ch. 2006-34 (H.B. 5023)  Provides for the resolution of collective bargaining issues at impasse between the State of Florida and specified certified bargaining units. Effective May 25, 2006.

Ch. 2006-35 (H.B. 5025)  Revises the required employer retirement contribution rates for the Florida Retirement System membership classes for fiscal years effective July 1, 2006, and July 1, 2007. Effective July 1, 2006.

Ch. 2006-36 (S.B. 152)  Reduces the required frequency for physical inspection of real property by a property appraiser for assessment purposes; permits review of image technology as necessary. Effective May 30, 2006.

Ch. 2006-37 (C.S. for C.S. for S.B. 170)  Permits certain direct service provider staff members to administer specified prescribed medications and to supervise self-administration; establishes prerequisites and circumstances. Effective May 30, 2006.

Ch. 2006-38 (C.S. for S.B. 264)  Provides an additional criterion for determining no change in ownership of homestead property for homestead assessment purposes; provides an exception. Effective July 1, 2006.

Ch. 2006-39 (S.B. 266)  Revises licensure and continuing education requirements for athletic trainers. Effective May 30, 2006.

Ch. 2006-40 (C.S. for S.B. 274)  Authorizes state parks to have functioning automated external defibrillators; requires training, maintenance, and location registration; provides immunity from civil liability. Effective July 1, 2006.

Ch. 2006-41 (C.S. for C.S. for S.B. 428)  Increases per diem and subsistence allowances and mileage rates for purposes of reimbursement of authorized travel expenses of public officers, employees, and authorized persons. Effective July 1, 2006.

Ch. 2006-42 (S.B. 490)  Requires reporting of specified tax assessment roll findings to certain House of Representatives committees and notification of certain county personnel of the availability of such findings. Effective July 1, 2006.

Ch. 2006-43 (S.B. 496)  Revises the membership, powers, and duties of the Citrus/Hernando Waterways Restoration Council. Effective May 30, 2006.

Ch. 2006-44 (C.S. for S.B. 738)  Revises motor vehicle registration application forms to permit applicants to contribute to the Miami Heart Research Institute. Effective July 1, 2006.

Ch. 2006-45 (C.S. for C.S. for S.B. 994)  Creates and revises provisions relating to citrus. Effective July 1, 2006.

Ch. 2006-46 (S.B. 1198)  Revises corporate income tax provisions to adopt the 2006 version of the Internal Revenue Code. Effective May 30, 2006, and retroactively operative to January 1, 2006.

Ch. 2006-47 (C.S. for S.B. 1268)  Revises the age requirement, income threshold, and interest rate relating to additional homestead tax deferrals. Effective July 1, 2006.

Ch. 2006-48 (S.B. 1282)  Establishes a K-8 virtual school program to facilitate academic instruction availability using on-line and distance learning technology; prescribes eligibility requirements and application, participation, and operation procedures. Effective May 30, 2006.

Ch. 2006-49 (S.B. 1284)  Permits the Agency for Health Care Administration to provide public access to certain reports electronically; requires specified print and Internet-generated consumer information and publications. Effective October 1, 2006.

Ch. 2006-50 (C.S. for C.S. for S.B. 1286)  Revises provisions relating to substance abuse and mental health services; abrogates the expiration of provisions relating to the appointment of specified substance abuse personnel and the establishment of mental health program offices. Effective May 30, 2006.

Ch. 2006-51 (C.S. for C.S. for S.B. 1328)  Creates and revises provisions relating to the crime of theft. Effective July 1, 2006.

Ch. 2006-52 (C.S. for S.B. 1590)   Permits certain dealers to forego the collection allowance for collecting certain taxes or fees and have such funds deposited into a specified trust fund; provides conditions. Effective January 1, 2007.

Ch. 2006-53 (S.B. 1756)  Removes the Secretary of State, Comptroller, Treasurer, and Commissioner of Education from the order of succession to the office of Governor; adds the Chief Financial Officer to the succession order. Effective May 30, 2006.

Ch. 2006-54 (S.B. 2434)  Prohibits the use of certain community college program, state university, and private college or university funds and public officer or employee travel expenses for activities related to or involving travel to a terrorist state. Effective July 1, 2006.

Ch. 2006-55 (C.S. for C.S. for S.B. 2728)  Creates and revises provisions relating to economic development incentives; creates the Innovation Incentive Program to facilitate the state’s effective competition for high-value research and development and innovation business projects. Effective July 1, 2006.

Ch. 2006-56 (H.B. 69)  Deletes a limitation on an exemption from the tax on sales, use, and other transactions for certain industrial machinery and equipment; repeals specified criteria regarding qualification for exemption and credit. Effective July 1, 2006.

Ch. 2006-57 (H.B. 415)  Revises provisions relating to the tax on sales, use, and other transactions regarding certain research and development costs and equipment. Effective July 1, 2006.

Ch. 2006-58 (H.B. 1237)  Creates the 21st Century Technology, Research, and Scholarship Enhancement Act to facilitate scholar recruitment and research and development; provides for specified programs and centers; authorizes colleges of medicine at the University of Central Florida and Florida International University. Effective July 1, 2006.

Ch. 2006-59 (H.B. 1285)  Expands an exemption from public records requirements for incentive programs to include the Innovation Incentive Program. Effective July 1, 2006.

Ch. 2006-60 (H.B. 1489)  Redesignates the Florida Space Authority as Space Florida; creates, revises, and repeals various provisions relating to the aerospace industry; requires establishment of the Florida Center for Mathematics and Science Education Research; prescribes center responsibilities. Effective May 30, 2006.

Ch. 2006-61 (H.B. 487)  Revises membership qualifications, terms of office, appointment procedures, and duties of the Commission for the Transportation Disadvantaged. Effective May 31, 2006.

Ch. 2006-62 (H.B. 5019)  Provides for creation of sheriff’s training and respect programs; prescribes eligibility criteria and operation procedures; provides for training requirements; conforms specified provisions; provides for waiver of specified fees upon parental completion of certain classes; repeals a provision relating to boot camps for children. Effective July 1, 2006.

Ch. 2006-63 (S.B. 692)  Exempts the sale of certain books, clothing, and school supplies from sales taxes for a specified time period; provides exceptions. Effective July 1, 2006.

Ch. 2006-64 (C.S. for S.B. 1506)  Permits specified viatical settlement provider information to be submitted electronically. Effective June 1, 2006.

Ch. 2006-65 (C.S. for C.S. for S.B. 1774)  Revises provisions relating to building codes; repeals a provision requiring specified periodic inspections. Effective July 1, 2006.

Ch. 2006-66 (H.B. 737)  For purposes of specified tax benefits, redefines the term “infrastructure” to include certain fixed capital expenditures or fixed capital outlay to improve specified private facilities made available as public emergency shelters or staging areas for emergency response equipment during officially declared emergencies. Effective July 1, 2006.

Ch. 2006-67 (H.B. 911)  Provides for the use of certain state facilities as emergency shelters during storms or other catastrophic events; requires an annual inventory of such facilities. Effective July 1, 2006.

Ch. 2006-68 (H.B. 1359)  Revises provisions relating to coastal protection, redevelopment, and management. Effective June 1, 2005.

Ch. 2006-69 (H.B. 1363)  Creates and revises provisions relating to affordable housing; repeals the State Farmworker Housing Pilot Loan Program and certain collection powers of the Florida Housing Finance Corporation. Effective July 1, 2006, except as otherwise provided.

Ch. 2006-70 (H.B. 1435)  Removes the Division of Emergency Management from the control, supervision, or direction of the Department of Community Affairs; provides for appointment of division director; provides for certain service agreements and interagency collaboration and coordination. Effective July 1, 2006.

Ch. 2006-71 (H.B. 7121)  Creates and revises provisions relating to emergency management. Effective June 1, 2006, except as otherwise provided.

Ch. 2006-72 (C.S. for S.B. 1172)  Creates a pilot program authorizing local government adoption of ordinances permitting public food service establishments to allow patrons’ dogs within certain designated outdoor portions of their establishments; establishes requirements and procedures. Effective July 1, 2006.

Ch. 2006-73 (H.B. 795)  Creates the First Generation Matching Grant Program to facilitate provision of grant-based student financial aid for specified undergraduate students; provides for fund allocation and grant award criteria and procedures; requires postsecondary institutions to include certain testing costs in the costs of attendance. Effective July 1, 2006.

Ch. 2006-74 (H.B. 7087)  Creates, revises, and repeals numerous provisions relating to education; creates the Division of Accountability, Research, and Measurement within the Department of Education. Effective June 5, 2006.

Ch. 2006-75 (C.S. for C.S. for S.B. 256)  Creates and revises provisions relating to scholarship program accountability. Effective July 1, 2006, except as otherwise provided.

Ch. 2006-76 (C.S. for C.S. for S.B. 1212)  Revises and readopts an exemption from public records requirements for certain individual agricultural records held by the Department of Agriculture and Consumer Services. Effective October 1, 2006.

Ch. 2006-77 (H.B. 191)  Creates and revises provisions relating to guardianship. Effective June 6, 2006.

Ch. 2006-78 (H.B. 821)  Revises provisions relating to the community contribution tax credit program regarding available tax credits, limitations for certain projects, and requirements and procedures used in granting such tax credits. Effective July 1, 2006.

Ch. 2006-79 (H.B. 5043)  Terminates, redesignates, and transfers specified trust funds; conforms certain provisions; provides for certain funds to be credited to the Rape Crisis Trust Fund. Effective July 1, 2006, except as otherwise provided.

Ch. 2006-80 (C.S. for C.S. for S.B. 142)  Revises provisions relating to price regulations for nonbasic telecommunication services and waives certain local exchange telecommunications companies’ service obligations; prescribes waiver conditions. Effective June 7, 2006.

Ch. 2006-81 (C.S. for C.S. for S.B. 258)  Requires identifying display stickers on farm labor vehicles and establishes safety standards for such vehicles; repeals a provision relating to transportation of migrant farm workers. Effective July 1, 2006.

Ch. 2006-82 (C.S. for C.S. for S.B. 262)  Revises provisions relating to administrative procedures including committee duties; parties in an action; rule adoption, publication, and challenge procedures; hearing procedures; and reporting requirements. Effective July 1, 2006, except as otherwise provided.

Ch. 2006-83 (S.B. 370)  Revises licensure requirements for speech-language pathologists and audiologists and certification requirements for their respective assistants. Effective July 1, 2006.

Ch. 2006-84 (C.S. for C.S. for S.B. 786)  Mandates and prescribes worksite notice requirements relating to the state minimum wage. Effective January 1, 2007.

Ch. 2006-85 (C.S. for S.B. 792)  Revises and readopts an exemption from public records requirements for certain return, account, or declaration information received by the Department of Revenue; conforms specified provisions. Effective October 1, 2006.

Ch. 2006-86 (C.S. for C.S. for S.B. 1080)  Creates, revises, and reenacts provisions relating to child protective services; repeals provisions relating to case plan and placement requirements, long-term custody, independent living, and termination of parental rights. Effective July 1, 2006.

Ch. 2006-87 (C.S. for C.S. for S.B. 1090)  Revises license renewal requirements for water well contractors; permits such contractors to facilitate the performance of certain work incidental to construction, repair, or abandonment of a water well; authorizes specified penalties for unlicensed practice of water well contracting. Effective July 1, 2006.

Ch. 2006-88 (C.S. for C.S. for S.B. 1112)  Prescribes procedures for county and municipal denial of applications for development permits. Effective October 1, 2006.

Ch. 2006-89 (C.S. for S.B. 1278)  Authorizes creation of the Interagency Services Committee for Youth and Young Adults with Disabilities to facilitate the transition to employment or further education for such persons; provides for membership, duties, reporting, and repeal. Effective June 7, 2006.

Ch. 2006-90 (C.S. for S.B. 1290)  Revises procedures relating to renewal of licenses to carry concealed weapons or firearms; tolls the license expiration for certain servicemembers; establishes timeframes and procedures. Effective July 1, 2006.

Ch. 2006-91 (C.S. for C.S. for S.B. 1510)  Provides criteria for designation of child care providers as Gold Seal Quality Care providers; provides for prolonged child care under certain conditions; revises certain screening, disciplinary, licensure, and scholarship provisions. Effective July 1, 2006.

Ch. 2006-92 (C.S. for S.B. 1540)  Revises provisions relating to limited prescription drug veterinary wholesalers regarding drug adulteration, permit requirements and fees, and establishment inspection. Effective July 1, 2006.

Ch. 2006-93 (C.S. for C.S. for S.B. 1678)  Requires that state agency fees for regulatory services or oversight of professions or businesses cover the costs of such services and oversight; requires periodic fee structure review. Effective July 1, 2006.

Ch. 2006-94 (H.B. 41)  Prescribes procedures for the administrative expunction of nonjudicial arrest records. Effective June 7, 2006.

Ch. 2006-95 (H.B. 125)  Requires dissemination of voter registration applications to the Fish and Wildlife Conservation Commission and locations where hunting, fishing, or trapping licenses or permits are sold; establishes procedures; prohibits the commission or its agents from soliciting, accepting, or collecting such applications. Effective June 7, 2006, except as otherwise provided.

Ch. 2006-96 (H.B. 147)  Prescribes the order of closing arguments in criminal prosecutions; repeals a specified rule of criminal procedure to conform. Effective October 1, 2006.

Ch. 2006-97 (H.B. 175)  Revises provisions relating to drug court programs. Effective June 7, 2006.

Ch. 2006-98 (H.B. 265)  Requires that certain lands managed by the Fish and Wildlife Conservation Commission be accessible and used for hunting; provides exceptions. Effective June 7, 2006.

Ch. 2006-99 (H.B. 271)  Provides for continued Department of Corrections custody of certain arrestees. Effective July 1, 2006.

Ch. 2006-100 (H.B. 285)  Clarifies the Governor’s emergency management powers regarding the seizure, taking, or confiscation of lawfully possessed firearms; reenacts provisions regarding certain emergency actions necessitated by a serious shortage of energy sources. Effective June 7, 2006.

Ch. 2006-101 (H.B. 421)  Continues an exemption from the tax on sales, use, and other transactions for certain property rented, leased, subleased, or licensed to concessionaires; provides timeframe for specified tax collection; abrogates the repeal of certain tax exemption provisions; revises provisions relating to certain admission taxes. Effective July 1, 2006.

Ch. 2006-102 (H.B. 687)  Provides an exemption from public records requirements for personal identifying information, held by the Division of Licensing, of persons who have applied for or received licenses to carry concealed weapons. Effective July 1, 2006.

Ch. 2006-103 (H.B. 1029)  Repeals provisions relating to the carrying of firearms in national forests; conforms specified provisions. Effective October 1, 2006.

Ch. 2006-104 (H.B. 1533)  Provides for the cleanup of certain petroleum contamination sites; creates presumptions; provides exclusions. Effective June 7, 2006.

Ch. 2006-234 (S.B. 124)  Provides that an employer law enforcement agency is not liable for injury, death, or property damage effected or caused during hot pursuit under specified circumstances. Effective June 20, 2006.

Ch. 2006-235 (C.S. for S.B. 508)  Provides for electronic monitoring of specified probationers or offenders registered as sexual predators or sexual offenders under certain conditions; redefines specified terms relating to residence. Effective July 1, 2006.

Ch. 2006-238 (S.B. 1076)  Requires that DUI education courses be conducted by certified instructors in classrooms in which both instructors and offenders are physically present; prohibits alternative instruction methods. Effective July 1, 2006.

Ch. 2006-239 (C.S. for S.B. 1370)  Permits the director of the Department of Veterans’ Affairs to waive the residency requirement for admittance to a veterans’ nursing home under specified circumstances. Effective July 1, 2006.

Ch. 2006-240 (C.S. for C.S. for S.B. 1450)  Creates the Donate Organs-Pass It On license plate; provides for annual use fee collection and distribution. Effective July 1, 2006.

Ch. 2006-241 (S.B. 1614)  Abrogates the expiration of provisions permitting issuance of free motor vehicle license plates to active members of the Florida National Guard. Effective June 20, 2006.

Ch. 2006-242 (C.S. for S.B. 1690)  Requires appointment of a physician assistant to specified probable cause panels; prescribes appointee’s qualifications and scope of duties. Effective July 1, 2006.

Ch. 2006-243 (C.S. for S.B. 1838)  Authorizes dispensing prescriptions contained in a common database under specified conditions; deletes a provision authorizing transfer of certain prescriptions by a community pharmacy. Effective July 1, 2006.

Ch. 2006-244 (C.S. for S.B. 2034)  Provides for educational opportunities for spouses of deceased or disabled servicemembers; prescribes qualifications and compliance requirements; prescribes use of funds. Effective July 1, 2006.

Ch. 2006-245 (C.S. for C.S. for S.B. 2184)  Prescribes procedures for parent relocation with a child. Effective October 1, 2006.

Ch. 2006-246 (H.B. 127)  Expands the Department of Education parental information guidelines to include specified school entry requirements, resource information, certain disease information, and information regarding available immunizations and vaccinations. Effective July 1, 2006.

Ch. 2006-247 (H.B. 187)  Prescribes the full information provided to a person or attorney regarding the results of certain blood, urine, or breath tests to determine the presence of alcohol, chemical substances, or controlled substances. Effective October 1, 2006.

Ch. 2006-248 (H.B. 241)  Provides for the enrollment of certain children in the Medikids or Florida Healthy Kids programs. Effective July 1, 2006.

Ch. 2006-249 (H.B. 273)  Prohibits the planting of trees or other vegetation in the view zone of certain outdoor advertising signs if such trees or vegetation will obstruct the view of such signs; authorizes a height increase for certain outdoor advertising signs under specified circumstances. Effective June 20, 2006.

Ch. 2006-250 (H.B. 573)  Exempts specified disabled veterans from certain license or permit fees relating to structural improvements upon a dwelling used as the veteran’s residence. Effective July 1, 2006.

Ch. 2006-251 (H.B. 699)  Revises domestic violence, HIV, and AIDS continuing education course requirements for certain health care practitioners; establishes certain supervisory protocols; repeals a provision permitting a specified alternative continuing education course. Effective July 1, 2006.

Ch. 2006-252 (H.B. 749)  Requires certain preliminary reports relating to new proposed sewerage systems or extension of existing systems; prescribes how the concurrency requirement may be met; permits government entities to grant a variance; provides exceptions; provides for certain corrective orders; increases continuing education requirements for septic tank contractors. Effective July 1, 2006.

Ch. 2006-253 (H.B. 849)  Requires the Florida Supreme Court to establish standards and procedures for qualifications, certification, conduct, discipline, and training of foreign language court interpreters. Effective July 1, 2006.

Ch. 2006-254 (H.B. 947)  Creates, revises, and reenacts provisions relating to long-term care insurance coverage; repeals specified determination of eligibility provisions. Effective June 20, 2006.

Ch. 2006-257 (H.B. 1247)  Requires the Agency for Health Care Administration and the Agency for Persons with Disabilities to develop a waiver program to serve children and adults with specified disabilities. Effective June 20, 2006.

Ch. 2006-258 (H.B. 1449)  Creates the Florida Center for Brain Tumor Research to coordinate public and private entity brain cancer research efforts and establish and maintain a brain tumor registry; provides for funding and establishment of an advisory council. Effective July 1, 2006.

Ch. 2006-259 (H.B. 1451)  Creates an exemption from public records requirements for specified individual information held by the Florida Center for Brain Tumor Research. Effective July 1, 2006.

Ch. 2006-260 (H.B. 7035)  Revises and readopts an exemption from public records requirements for certain motor vehicle crash reports; conforms specified provisions. Effective October 1, 2006.

Ch. 2006-261 (H.B. 7073)  Redesignates a state center and an advisory council; revises provisions relating to the compilation of health-related data and statistics; provides for a secure facility to house data and backup systems held by the Agency for Health Care Administration. Effective June 20, 2006.

Ch. 2006-262 (H.B. 7089)  Revises provisions relating to retained spring training franchises; provides criteria for certification and funding of motorsports entertainment complexes; prescribes use of funds. Effective July 1, 2006.

Ch. 2006-263 (H.B. 7115)  Revises and readopts an exemption from public records requirements for autopsy photographs and audio and video recordings held by a medical examiner. Effective October 1, 2006.

Ch. 2006-264 (H.B. 7127)  Provides penalties for willfully interrupting or disturbing an assembly of people gathered for a military funeral honors detail. Effective June 20, 2006. .

Ch. 2006-265 (H.B. 7151)  Provides criteria and procedures for disestablishing paternity and terminating child support obligations; provides exceptions; revises provisions relating to certain adoption consent and notice; requires specified notice regarding termination of parental rights. Effective June 20, 2006.

Ch. 2006-266 (H.B. 7177)  Revises the time limitations for commencement of prosecution of certain offenses; provides that prosecution of specified offenses may be commenced at any time after the identity of the accused is or should have been established through the use of DNA evidence. Effective July 1, 2006.

Ch. 2006-267 (H.B. 7201)  Eliminates the acts of photographing, filming, videotaping, or recording from the offense of voyeurism. Effective July 1, 2006.

Ch. 2006-268 (C.S. for C.S. for S.B. 980)  Creates provisions relating to an electric utility substation approval process, electric transmission and distribution line right-of-way maintenance, and electric substation planning. Effective June 22, 2006.

Ch. 2006-269 (C.S. for C.S. for S.B. 1324)  Creates the Lead Poisoning Prevention and Screening Education Act to facilitate prevention and treatment of childhood lead poisoning; provides for state agency collaboration on programs to prevent obesity; includes certain wellness benefits in HMO services; creates the Florida State Employee Wellness Council; provides for membership, term of office, and duties. Effective July 1, 2006.

Ch. 2006-270 (S.B. 1386)  Revises court sentencing options for youthful offenders in a youthful offender basic training program who violate their conditions of probation. Effective July 1, 2006.

Ch. 2006-271 (S.B. 1408)  Establishes procedures for electronically generated and transmitted prescriptions; defines the term “records custodian” and mandates compliance with certain confidentiality and disclosure requirements. Effective July 1, 2006.

Ch. 2006-272 (C.S. for S.B. 1620)  Creates and revises provisions relating to motor vehicle service agreement companies, home warranty associations, and service warranty associations; repeals the 10-day cancellation period for warranties sold in connection with specified loans. Effective July 1, 2006.

Ch. 2006-273 (S.B. 1948)  Mandates specified disclosures prior to execution of a contract for sale and purchase of certain coastal real property. Effective July 1, 2006.

Ch. 2006-274 (C.S. for S.B. 1956)  Claries provisions relating to land trust transfers; vesting; beneficiary rights, liabilities, and duties; appointment of successor trustees; and entitlement to principal residence homestead tax exemption under certain circumstances. Effective October 1, 2006.

Ch. 2006-277 (H.B. 299)  Prohibits an insurance agency from establishing life insurance limitations based solely on the insured’s past foreign travel experiences or future foreign travel plans; provides for specified exceptions; penalizes violations. Effective July 1, 2006.

Ch. 2006-278 (H.B. 755)  Limits the scope of an administrative law judge’s review of certain state agency procurement decisions. Effective July 1, 2006.

Ch. 2006-279 (H.B. 827)  Revises pretrial release provisions to require separate and specific bail amounts for each charge or offense and compliance with release conditions; clarifies bond forfeiture and cancellation provisions. Effective October 1, 2006.

Ch. 2006-285 (H.B. 1563)  Revises exemptions from public records requirements relating to social security numbers and specified bank account information; requires the county recorder to redact specified information from electronically stored records; provides immunity from liability for specified court personnel for the inadvertent release of certain information. Ch. 2006-286 (H.B. 7013)  Revises provisions regarding copyright of data processing software created by governmental agencies; provides for the use of funds derived from the sale or licensing of such software; removes the scheduled repeal of an exemption from public records requirements. Ch. 2006-287 (H.B. 7059)  Revises and readopts exemptions from public records requirements for personal identifying information held by temporary cash assistance programs; provides an exemption from public meeting requirements for meetings held by specified governmental entities. Ch. 2006-288 (H.B. 7063)  Revises and readopts an exemption from public records requirements for personal identifying information held by a specified Alzheimer’s center and its support entities. Effective October 1, 2006.

Ch. 2006-289 (H.B. 7075)  Creates and revises provisions relating to the Department of Agriculture and Consumer Services; designates a specified inspection station as the “Austin Dewey Gay Memorial Agricultural Inspection Station.” Effective July 1, 2006, except as otherwise provided.

Ch. 2006-291 (H.B. 7131)  Revises provisions relating to the redevelopment of brownfields; permits additional tax credits for certain affordable housing construction on a brownfield site; repeals provisions relating to Brownfield Property Ownership Clearance Assistance and its revolving loan trust fund. Effective July 1, 2006.

Ch. 2006-292 (H.B. 61)  Creates and revises provisions relating to postsentencing DNA testing for certain felons; provides timeframe for government disposal of physical evidence in specified cases; repeals a specified Florida Rule of Criminal Procedure. Ch. 2006-297 (H.B. 1589)  Creates the Homeownership For All and the Future Farmers of America license plates; provides for annual use fee collection and distribution for specified plates; redesignates the Florida Memorial College license plate as the Florida Memorial University license plate; creates Senate President and House Speaker license plates. Ch. 2006-298 (C.S. for C.S. for S.B. 214)  Prescribes the training in and use of dart-firing stun guns by law enforcement, correctional, or correctional probation officers; revises provisions relating to public possession and use of such stun guns. Effective June 26, 2006.

Ch. 2006-299 (C.S. for S.B. 640)  Provides criminal penalties for persons 18 years old or older who intentionally lure or entice or attempt to lure or entice children under 12 years of age into a structure, dwelling, or conveyance for unlawful purposes; provides enhanced penalties for a successive conviction. Effective July 1, 2006.

The State Constitution

S.J.R. 2788  Rescinds and withdraws H.J.R. 1177, 2005 Regular Session, which proposed an amendment to s. 4, Art. VI of the State Constitution and creation of s. 26, Art. XII to change the term limits for certain elected constitutional officers from eight consecutive years to twelve consecutive years.

H.J.R. 353  Proposes an amendment to s. 6, Art. VII and the creation of s. 26, Art. XII of the State Constitution to increase the maximum additional homestead exemption for low-income seniors from $25,000 to $50,000 and to schedule the amendment to take effect January 1, 2007, if adopted.   To be submitted to the electorate for approval or rejection at the general election to be held in November 2006 or at an earlier specifically authorized special election.

H.J.R. 631  Proposes an amendment to s. 6, Art. VII of the State Constitution to provide a discount from the amount of ad valorem taxation levied on the homestead of a veteran who meets specified criteria.  To be submitted to the electorate for approval or rejection at the general election to be held in November 2006 or at an earlier specifically authorized special election.

H.J.R. 1569  Proposes an amendment to s. 6, Art. X of the State Constitution to prohibit transfer of private property taken by eminent domain to a natural person or private entity except by general law passed by a three-fifths vote of each house of the Legislature.  To be submitted to the electorate for approval or rejection at the general election to be held in November 2006 or at an earlier specifically authorized special election.
